Terms of Service

1. Acceptance of Terms
By accessing or using CallWise ("Service"), operated by AwesomeWorks AI ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
CallWise is a SaaS platform that provides automated analysis and scoring of sales calls using artificial intelligence, including speech-to-text transcription, conversation analysis, and performance scoring.
3. User Accounts
To use the Service, you must create an account or be invited by an organization administrator. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You must provide accurate and complete information when creating an account.
- You must be at least 18 years old to use the Service.
- You are responsible for all activity under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Upload content that you do not have the right to share.
- Use the Service for any unlawful purpose or in violation of applicable laws.
- Attempt to gain unauthorized access to the Service or its systems.
- Interfere with or disrupt the Service or servers connected to the Service.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Upload malicious files or content designed to harm the Service.
5. Audio Data & Recordings
You represent and warrant that you have obtained all necessary consents and permissions to upload and process audio recordings through the Service. You are solely responsible for compliance with applicable recording consent laws in your jurisdiction.
We process uploaded audio recordings solely for the purpose of providing the Service. Audio files are stored securely and handled in accordance with our Privacy Policy.
5a. VoIP Telephony & Call Recording
CallWise offers integrated VoIP telephony features that enable you to make and receive phone calls directly through the Service. All calls made or received through CallWise telephony are automatically recorded for transcription, analysis, and quality scoring purposes.
By enabling the telephony feature, you acknowledge and agree that:
- Your responsibility: You are solely responsible for informing all call participants that the call is being recorded, in compliance with all applicable laws and regulations.
- Consent obligation: You must obtain any required consent from call participants before or at the beginning of each recorded call.
- Data controller: For audio data captured through VoIP telephony, your organization acts as the data controller under GDPR (Art. 4(7)). CallWise acts as a data processor (Art. 28).
- No liability: CallWise shall not be held liable for any failure by you to comply with applicable recording consent laws.
- Third-party services: VoIP telephony is powered by Twilio Inc. Your use of telephony features is also subject to Twilio's Terms of Service.
6. Intellectual Property
The Service, including its design, features, and content (excluding user-uploaded data), is owned by AwesomeWorks AI and is protected by intellectual property laws. You retain ownership of all audio recordings and data you upload to the Service.
7. Multi-Tenant Isolation
The Service operates on a multi-tenant architecture. Your organization's data is logically isolated from other organizations. We implement technical safeguards to prevent cross-tenant data access.
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
9. Limitation of Liability
To the maximum extent permitted by law, AwesomeWorks AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service.
The AI-generated analysis and scores provided by the Service are for informational purposes and should not be the sole basis for employment or personnel decisions.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Poland. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction in Poland.
